Community Associations

  • HOA General Counsel

    We serve as general counsel to condominium and homeowner associations. This includes drafting resolutions, attending and chairing owner meetings, advising the board of directors, and handling legal issues as they arise.

  • Governing Document Review

    If your governing documents are outdated, developer-drafted, or simply hard to follow, we will perform a thorough review. Governing documents include the Declaration or CC&Rs, Bylaws, Articles of Incorporation, Rules and Regulations, and Resolutions. The review concludes with written recommendations on which provisions should be modified or removed, and why. We also assist with electronic voting and recording amended documents with the county.

  • Document Amendment

    Over time, governing documents become outdated or unworkable. We identify which provisions need to be amended, draft the changes, and guide the association through the voting process required for amendments to pass.

  • Enforcement

    Most associations encounter owners who violate the rules or governing documents. We help your association achieve and maintain compliance.

  • Assessment Collection

    When owners refuse to pay their assessments, we help associations collect through personal judgment actions or foreclosure of the association's lien.

  • Construction Defects

    Your home is your most valuable asset. If it has construction defects, we will assist you in bringing claims against the developer or builder to recover the cost of repairs. In most cases, we handle construction defect claims on a contingent fee basis.

  • Floating Homes / Moorages

    Floating homes and moorage communities are governed by specialized statutes that require particular expertise. We represent floating home and moorage communities in Oregon and Washington, providing services that include bylaw revisions, drafting membership or slip certificates, enforcement, and general litigation.

    We draft easements for landowners, including access, utility, airspace, and encroachment resolution easements.

  • Boundary Disputes

    Some neighbor disputes can only be resolved through legal intervention. We work with expert surveyors and litigate these cases when necessary.

  • Joint Ownership Agreements

    Whenever you purchase real estate with another person or entity, a joint ownership agreement protects all parties by governing the relationship between co-owners.

  • Land Sale Contracts

    Land sale contracts — also known as seller-carried agreements — allow buyers and sellers to transfer ownership without a traditional lender. We draft these agreements regularly.

  • Residential Purchase Reviews

    Buying a home or condominium is one of the most significant decisions you'll make. We review the CC&Rs, bylaws, reserve funding, and association meeting minutes, then provide buyers with a clear assessment of the community's financial and legal health.

  • Residential Disclosure Claims

    We represent buyers and sellers in claims arising from residential real estate transactions, including failure to disclose material facts, earnest money disputes, and breach of purchase and sale agreements.
